Property Damage
Property Damage. Customer must disclose any fragile, high-value, pre-existingdamaged, or sensitive-surface items (including materials requiring special care) prior toservice; Sparkle Squad is not liable for damage resulting from non-disclosure. Any claimof property damage must be submitted in writing by the account holder within 48 hoursof the service date, accompanied by photographic evidence. Claims not meeting theserequirements may be declined at Sparkle Squad’s discretion. Sparkle Squad’s sole andexclusive liability for verified property damage is limited to repair, replacement, orreimbursement (at Sparkle Squad’s discretion) not to exceed the amount paid for theapplicable service, and excludes any consequential, incidental, or indirect damages. Anylegal action related to a property damage claim must be commenced within six (6)months of the service date. (6-month limitations period needs lawyer confirmation ofenforceability)
Independent Contractors
Independent Contractors. Cleaning services under this Agreement may be performedby independent contractors retained by Sparkle Squad (“Contractors”). Contractors arenot employees, agents, or partners of Sparkle Squad. Sparkle Squad remains theCustomer’s primary point of contact for service-related claims as set forth in thisAgreement.
Cancellation, Rescheduling, and No-Shows
Cancellation, Rescheduling, and No-Shows. Cancellations or rescheduling requestsmust be made at least 24 hours before the scheduled service time. Requests made withless than 24 hours’ notice, including rescheduling requests, will incur a fee equal to 50%of the total service price, charged to the payment method on file. If Sparkle Squad’scleaner arrives at the scheduled time and is unable to access the property for any reason(including but not limited to no one present, incorrect access information, or deniedentry), this will be treated as a no-show and the full service price will be charged. Tocancel an ongoing recurring service plan, Customer must provide at least 7 days’ writtennotice prior to the next scheduled cleaning. Sparkle Squad reserves the right to requireprepayment in full or decline future bookings for customers with a pattern of latecancellations or no-shows.
Service Estimates and Additional Charges
Service Estimates and Additional Charges. Quotes for services are estimates based oninformation provided by Customer at the time of booking. By booking a service,Customer authorizes Sparkle Squad to charge additional fees, up to 25% above theoriginal quoted price, if the actual condition or scope of the property differs from theinformation provided at booking. Any such additional charge will be supported byphotographic documentation and Customer will be notified via text or call at or near thetime of service. Additional charges exceeding 25% of the original quote require directcustomer contact and consent prior to being charged.
Dispute Resolution and Arbitration
Dispute Resolution and Arbitration. Prior to initiating any dispute, Customer agrees toprovide Sparkle Squad with written notice and allow thirty (30) days for good-faithresolution. Any dispute not resolved through this process shall be resolved exclusivelythrough binding arbitration administered by the American Arbitration Association inMiami-Dade County, Florida, except that either party may bring an individual action insmall claims court. Sparkle Squad shall bear the cost of the arbitration filing fee.Arbitration proceedings shall be confidential. Customer and Sparkle Squad each waiveany right to a jury trial and to participate in a class action, class arbitration, orrepresentative action; all disputes must be brought in an individual capacity only. Anydispute regarding the validity or enforceability of this arbitration clause shall itself bedecided by the arbitrator. If any portion of this clause is found unenforceable, theremainder shall remain in full effect. In any arbitration or legal proceeding arising underthis Agreement, the prevailing party shall be entitled to recover reasonable attorney’sfees and costs.
Photography and Media
Photography and Media. Sparkle Squad may take before-and-after photographs orvideo during the course of service for quality assurance, training, and marketingpurposes, including use on our website and social media. Customer’s personalinformation (name, address) will not be disclosed in connection with any such use unlessseparately agreed to in writing. Customers who do not wish to have photos or video usedfor marketing purposes may opt out by notifying Sparkle Squad in writing prior to service.
Non-Solicitation
Non-Solicitation. Customer agrees not to directly hire, engage, or solicit any cleaner orcontractor introduced through Sparkle Squad for independent cleaning services, outsideof Sparkle Squad, during the service relationship and for twelve (12) months following thelast scheduled service. Violation of this provision will result in a placement fee of $2,500,payable to Sparkle Squad, in addition to any other remedies available.
Entire Agreement / Integration
Entire Agreement. These Terms, together with any specific booking confirmation,constitute the entire agreement between Customer and Sparkle Squad and supersedeany prior or contemporaneous verbal representations, promises, or agreements,including any statements made by phone or in person. These Terms may only bemodified as set forth in the “Changes to These Terms” section above.
Force Majeure
Force Majeure. Sparkle Squad shall not be liable for any delay or failure to performservices resulting from events beyond its reasonable control, including but not limited tohurricanes, severe weather, natural disasters, government orders, power outages, orother acts of God. Affected services will be rescheduled as soon as reasonably possibleat no penalty to either party.
Right to Refuse or Terminate Service
Right to Refuse or Terminate Service. Sparkle Squad reserves the right to decline,refuse, or terminate service to any customer at its sole discretion, including but notlimited to situations involving non-payment, unsafe conditions, or abusive or threateningbehavior toward Sparkle Squad personnel.
Services
The Sparkle Squad Co. provides professional cleaning services (the "Services"). The details of the Services, including pricing, scope, and any specific terms, will be provided at the time of booking and are subject to change at our discretion.

User Responsibilities
By using our website and services, you agree to:
- Provide accurate, current, and complete information when creating an account or booking a service.
- Maintain the security of your account and notify us immediately of any unauthorized use.Use the website and services in compliance with all applicable laws and regulations.
- Refrain from engaging in any activity that disrupts or interferes with the website or services.
- Booking: To book a service, you must provide accurate information and select a time and date that suits you. Bookings are subject to availability.
- Payment: Payment for services will be charged at the conclusion of service, however an authorized hold will be placed on your payment method of choice 24 hours before you booking starts. We accept various payment methods: Zelle, Apple Pay, or any major credit card / debit card.
- Cancellation and Refunds: Cancellations must be made at least 24 hours before the scheduled service time. Failure to cancel within this timeframe may result in a cancellation fee of 50% of your total clean. Refunds will be issued according to our cancellation policy, which is available on our website.
Limitation of Liability
To the fullest extent permitted by law, The Sparkle Squad Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use the website or services.Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from the website or services.Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website by any third party.
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the website or services.
Indemnification
You agree to indemnify and hold The Sparkle Squad Co., its affiliates, officers, agents, employees, and partners harmless from any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the website or services, your violation of these Terms, or your violation of any rights of a third party.
SERVICE ESTIMATES
Quotes for Cleaning packages are estimates based on information provided at booking. Final pricing is confirmed on-site before work begins, based on the actual condition of the property and the scope of work required. If the condition of the home differs from the information provided during booking, additional charges may apply to cover the additional time, labor, and resources needed to complete the service.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. You are advised to review these Terms periodically for any changes. Your continued use of the website or services after the posting of changes constitutes your acceptance of the new Terms.
Governing Law
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
